Renting conditions for vacation homes, ski huts, group accommodations, hotel, pensions

1. Applicants - tenants:

Berg & Tal Natursportreisen GmbH rent only on from the applicant arranged closed groups, which are recruited and arranged by the respective group leader or a body of the public or private right; at groups, which are not bodies, the letting takes place exclusive to the applicant.

2. Conclusion of the lease:

With a written reservation, which is made by a participant of age, the customer offers the conclusion of a travel contract obligatorily and clings in case of a cancellation starting from this time. Mailing the bookkeeping form over the Internet is possible only if the acknowledgment of these trading conditions were confirmed, thus is this basis of the travel contract. The travel contract is confirmed by a written reservation confirmation/calculation by Berg & Tal Natursportreisen GmbH - as desired of the customer - by email (when pdf), by fax or by letter post. Depending upon season time the confirmation takes place within 1 to 7 days after reservation entrance.

3. The pre-payment

20% of the total rent, at least 100,- euros and maximally 260, - euros per person.
The pre-payment is to be paid only after receipt of a Sicherungsschein in accordance with §651k BGB.
Pre-payment for reservations of outside of the FRG: For reservations, which do not come from the Federal Republic of Germany, a pre-payment at a value of 50% of the travel price, for at least 100,- euros - euros and maximally 260, - euros per person.

The remainder must have been received at the earliest 30 days and at the latest 14 days before travel beginning with Berg & Tal Natursportreisen GmbH. The dispatch of the renting documents takes place approx. 10-14 days before beginning of renting, if the total amount was received completely. If the total amount was received not completely before beginning of renting, no admission to the renting object is granted.
If the total amount is transferred in more than 2 rates (pre-payment and remainder), we compute 10, - euros per additional partial payment. Additional entries which require an additional additional payment rate, are exceptional from.

4. Achievements:

The capacity results from the written registration confirmation, in also locally resulting additional expenses, a bail as well as special conditions, how bring along of domestic animals and the final purification are proven. If it should deviate from the advertisement, expressly to it one refers.

4a. Not in requirement taken achievements:

If tenants select after beginning of renting another than the booked accommodation and food supply or without the obtained achievements totally or partly do, no reimbursement, takes place is, achievements deviate from in the travel contract the specified. This is valid also with premature home journey, e.g. because of injury or illness. If tenants should later than to the publicized date journeys, it is not possible to attach the missed days free of charge at the conclusion of the renting period.

4b. Obligation to cooperate with differences to the exposed version:

If the tenant determines with beginning of renting differences to the exposed version at the object, it must ask immediately the landlord for remedy and if this does not take place, Berg & Tal Natursportreisen GmbH of it to inform so that Berg & Tal Natursportreisen GmbH has the possibility with the landlord on remedy for urge or a comparable spare accommodation to offer.

If the tenant of this obligation to cooperate does not follow, it cannot make warranty claims valid to a later time. Warranty claims must be made valid within one month after rentings. We recommend writing because of the better proof possibility.

4c. Price or changes of achievement:

Berg & Tal Natursportreisen GmbH are justified for important reasons to make changes of individual renting achievements which become necessary after conclusion of a contract, if the total cut of the renting offer is not impaired and this for the tenant is reasonable.

5. Adhesion:

The adhesion the Berg & Tal Natursportreisen GmbH for damage, which is not body damage, is limited to the three-way rent,

1. so far a damage of the tenant is roughly negligently caused neither deliberately, nor or
2. so far the Berg & Tal Natursportreisen GmbH for the tenant developing a damage alone because of being to blame for a service provider is responsible. If international conventions are valid or on such being based laws for from a service provider to which can be furnished an achievement, according to which a requirement on payment of damages develops only under certain conditions or for restrictions or can be made valid or is under certain conditions impossible, then itself the Berg & Tal Natursportreisen GmbH opposite the tenant on that appoint. It is valid § for 651 f exp. 1 BGB. If an offer is only obtained, then the respective organizer is responsible for the contribution of the achievements. Berg & Tal Natursportreisen GmbH function only as a mediator.

5a. Adhesion for damage to the renting object:

The tenant is obligates the renting object with greatest possible care to treat. Damage to facility or utensils of the object is immediate the landlord and/or key owner or if this cannot be attained communicate Berg & Tal Natursportreisen GmbH. The tenant sticks in its entirety for damage and rough pollution to the renting object and pertinent property.

5b. Adhesion for invoice amounts for beverages, meals, other auxiliary services:

The tenant and/or applicant of a group is responsible to meals, other auxiliary services, which were consumed e.g. in a booked pension however were inadvertently not paid for open invoice amounts for beverages. Berg & Tal Natursportreisen GmbH are from the landlords authorize these invoice amounts entgegenzunehemen or if necessary by late-payment notice to call in.

6. Resignation or changes of reservation by the tenant:

The tenant can withdraw at any time before beginning of renting from the lease - from arguments we recommend writing. If the tenant can place a same number of spare tenants to the same reservation date for the same renting object to the same rent, then only a transfer posting fee of 10% of the rent, at least however 50,- euros computes. If important reasons speak as described in § 651 b exp. 1 BGB against the reservation of a spare person posed, then we keep the right before these to reject itself. All other changes of reservation or a missing confirmation, which require dispatching a new reservation confirmation, overall with 20, - euros computed - of it exceptionally are additional entries of additional participants or extensions of the renting period, who take place before the journey date. If no spare person is placed, tenants result the following costs of the participants, and/or the responsible persons:

6a. With total reservations to 14 persons:

- until 61 days before beginning of renting 25% of the total price
- until 35 days before beginning of renting 50% of the total price
- until 8 days before beginning of renting 80% of the total price
- until 2 days before beginning of renting 95% of the total price
- starting from 1 day before beginning of renting or with Nichtantritt 100% of the total price

6b. With total reservations starting from 15 persons:

- until 25 weeks before beginning of renting 20% of the total price
- 24 to 21 weeks before beginning of renting 40% of the total price
- 20 to 17 weeks before beginning of renting 60% of the total price
- 16 to 9 weeks before beginning of renting 80% of the total price
- 8 to 4 weeks before beginning of renting 90% of the total price
- 4 weeks until 2 days before beginning of renting 95% of the total price
- starting from 1 day before beginning of renting or with nonappearance 100% of the total price

6c. Special cancellation agreement Christmas date:

Is valid for offers, which are combined offered both only over Christmas and Christmas and New Year's Eve, if only the Christmas days are booked and the complete group cancellation these Christmas days again. With cancellation of individual participants the cancellation costs are valid as indicated by 7a and 7b.

- until 91 days before beginning of renting 70% of the total price
- starting from 91 days before beginning of renting 95% of the total price


The date of receipt of the declaration of withdrawal is relevant with “mountain & valley”. The proof is open to the tenant that the economic damage is smaller than the overall percentages.

We recommend the conclusion of an insurance for travel resignation cost protection (RRKS)!

7. Insurance:

Each tenant e.g. is for his insurance protection. Ill or liability insurance responsible.

8. Validity:

9. Inefficacy of individual regulations:

If one of the travel conditions should be ineffective, then the remaining conditions remain of it untouched. It is valid in this case the generally valid travel right.

10. Area of jurisdiction:

Place of delivery and exclusive area of jurisdiction for commercial Contracting Parties or such, that do not have a general area of jurisdiction inland, is our company headquarters (AG (court) Leverkusen).
